Steele Hays, Justice,

¶1dissenting. The trial court heard the testimony in this rather unusual case and concluded that the verdict was clearly against the preponderance of the evidence. In his judgment a new trial was warranted and as I cannot say his discretion was abused, I would affirm.

Glaze, J., joins this dissent.
