¶1We have for review a report of the referee in this disciplinary action in which it is recommended that respondent, John S. Matthews, receive a public reprimand.
¶2After reading the briefs, examining the record and having heard oral argument, we do not feel even a private reprimand is justified. Therefore, the complaint is hereby dismissed and costs of these proceedings shall be borne by The Florida Bar.
¶3It is so ordered.
