1. “THE STATE: Lastly, if this Court decides to keep with its original decision and while ordering a new trial, then the State would ask for Findings of Fact and Conclusions of Law in order to ascertain what the basis was so we can then pursue an appeal. THE COURT: Okay. And I think I can just cut the chase on that. THE STATE: Okay. THE COURT: It’s in the interest of justice. After hearing this case, it was one that stayed on my mind. I didn’t have to think about it too long when the Motion was submitted because I questioned the case at the time of trial; and so, I am going to grant a new trial in the interest of justice and the issue that it’s a new trial.
