30 Misc. 762

Pascarela v. Manello

Appellate Terms of the Supreme Court of New York · decided 1899-12-15

Appeal by the defendant from a judgment rendered in favor of the plaintiff in the Municipal Court, second district, borough of Manhattan.

Decided 1899-12-15

Freedman, P. J.

¶1The record in this case discloses nothing but a conflict of evidence upon a disputed question of fact. Bo objections were made, nor exceptions taken to the reception or exclusion of any of the testimony, nor does it appear that injustice has-been done. The judgment must, therefore, be affirmed.

¶2MacLean and Leventritt, JJ., concur.

¶3Judgment affirmed, with costs.
