Most-quoted passages
The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 9 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.
““We have examined many cases involving deaths from drowning, wherein the issue of the causal connection between defendant’s negligence and the death of plaintiff’s decedent was discussed. * * * Some of the cases hold as a matter of law that defendant’s negligence was not the proximate cause of the drowning while others hold the proximate cause was for the jury. We think the better reasoning is found in the cases wherein defendant’s negligence was found sufficient to make the issue of proximate cause one for the jury’s determination.” (Emphasis supplied)”
