The administration of electroshock therapy to an involuntarily committed minor patient in a state mental hospital without the consent of the minor's guardian is not cruel and unusual punishment or an unconstitutional invasion of the right to privacy.</block_quote> <bold>State — treatment of patient in state mental hospital —</bold> <bold>rights of state</bold>. <block_quote> 2. The state by reason of the commitment itself has certain rights under the parens patriae doctrine.</block_quote> <bold>Same — same — same — immunity from suit of state officials</bold>. <block_quote> 3. Qualified immunity protects a state official from liability for damages unless that official knew or should have known that the action he took within the sphere of official responsibility would violate the constitutional rights of another or unless he took the action with malicious intent to cause a deprivation of constitutional rights or other injury to another.</block_quote> <bold>Mental health — treatment of mentally ill in state hospital —</bold> <bold>use of intrusive forms of treatment — procedure to be</bold> <bold>adopted</bold>. <block_quote> 4. In future cases the state must adopt a procedure requiring the appointment of a legal guardian before the appropriate county court and gain consent of that court to apply intrusive forms of treatment which, though not clearly defined, shall include electroshock therapy.</block_quote>
