1. ““The power [of the commissioner to forfeitj is dependent upon the fact. Where the fact of abandonment does not exist, the power of forfeit on this ground does not exist. The court, upon sufficient evidence, as we think, found that no abandonment of the land in controversy had occurred on January 22, 1901, when the commissioner attempted to forfeit it, and the attempt, therefore, had no force or effect whatever. He hence could certainly cancel and set aside as he did, on February 7, 1901, the unauthorized, inadvertent attempt to forfeit.””
