322 Ark. 296

Huckabee v. State

Supreme Court of Arkansas

Decided October 30, 1995

Supreme Court of Arkansas · decided 1995-10-30

Relies on Rogers v. State

Decided 1995-10-30

Per Curiam.

¶1Johnnie Huckabee, by his attorney, has filed

¶2a motion for a rule on the clerk. His attorney, Jon A. Williams, admits by motion that the record was tendered late due to a mistake on his part.

¶3 We find that such an error, admittedly made by the attorney for a criminal defendant, is good cause to grant the motion. See In Re: Belated Appeals in Criminal Cases, 265 Ark. 964 (1979) (per curiam). The motion is, therefore, granted.

¶4A copy of this opinion will be forwarded to the Committee on Professional Conduct.
