¶1(concurring specially) .

¶2In order that the law be stable and certain, and in conformity with the time-honored principle of stare decisis, I concur. Shelby v. State, supra, and Walden v. State, supra, have become binding precedents. However, I yet adhere to my views as expressed in the dissenting opinion in Walden v. State, supra.
