SUMMERS, Justice

¶1(dissenting).

¶2A driver crossing the mid-line of the highway, “straddling” the center line of the road, unable to pass a sobriety test by touching his nose with his finger and who expels an odor of alcohol demonstrates “some evidence” of driving while intoxicated, upon which the trier of fact could return a verdict of guilty.

¶3I would not reverse this conviction.
