330 Ark. 297

McIntosh v. State

Supreme Court of Arkansas

Decided October 16, 1997

Supreme Court of Arkansas · decided 1997-10-16

Relies on Rogers v. State

Decided 1997-10-16

Per Curiam.

¶1Robert Say McIntosh, by his attorney, has filed a motion for rule on the clerk.

¶2His attorney, Alvin D. Clay, admits in his motion that the record was tendered late due to a mistake on his part.

¶3We find such an error, admittedly made by the attorney for a criminal defendant, is good cause to grant the motion. See In Re: Belated Appeals in Criminal Cases, 265 Ark. 964 (1979) (per curiam).

¶4 The motion for rule on the clerk is, therefore, granted. A copy of this opinion will be forwarded to the Committee on Professional Conduct.
