¶1*644In re: Ruby Gardner, applying for writs of certiorari, review, prohibition, mandamus and for Stay Order.

¶2Writ refused. Upon the assignments of error made, there is no error in the rulings of the trial judge.

DIXON, J.,

¶3is of the opinion that trying two cases against different people, in which the complaining witness in each case is the defendant in the other, over the objection of one, is probable error discoverable by inspection of the pleadings and proceedings and the writ should be granted.

CALOGERO, J., is of the opinion the writ should be granted.
