¶1In re: Gloria Walker applying for cer-tiorari, or writ of review, to the Court of Appeal, 331 So.2d 167, Third Circuit, Parish of LaSalle.

¶2Writ denied. On the facts found by the court of appeal, there is no error of law in the judgment complained of.

TATE, J.,

¶3respectfully dissents. Although the majority characterizes the issue as factual, the findings of the trial court show disabling aggravation of a pre-exist-ing condition, which evidence, in my opinion, was incorrectly construed as not proving an “accident”.
