¶2It is Judge Irigoin’s opinion that the sentence is excessive in that it is not consistent with similar crimes in Yellowstone County and that the defendant had no prior felonies. Judge Irigoin added that her decision would have been to amend the sentence to a five (5) year deferred sentence with a $1,000.00 fine.
