““[1] Thus is presented the question, whether the foregoing evidence establishes to a legal certainty that plaintiff’s claim is less than the jurisdictional amount of $10,000.00. Before dismissal may be made for lack of jurisdictional amount, it must appear to a legal certainty that the claim is less than the jurisdictional amount.
