340 Ark. 198

Arnett v. State

Supreme Court of Arkansas

Decided January 20, 2000

Supreme Court of Arkansas · decided 2000-01-20

Relies on Rogers v. State

Decided 2000-01-20

PER Curiam.

¶1Carolyn Arnett, by her attorney, has filed a motion for rule on the clerk.

¶2Her attorney, Herbert T. Wright, Jr., admits in his motion that the record was tendered late due to a mistake on his part.

¶3 We find that an error, admittedly made by the attorney for a criminal defendant, is good cause to grant the motion. See In Re: Belated Appeals in Criminal Cases, 265 Ark. 964 (1979) (per curiam).

¶4The motion for rule on the clerk is, therefore, granted. A copy of this opinion will be forwarded to the Committee on Professional Conduct.
