“[Sjections 12-37-90 and 12-60-2540 gave Antley, as county tax assessor, the right to file appeals to the ALJD and established her status as a real party in interest in such appeals. These sections thus permitted, but did not require, Antley to appeal adverse board decisions. Moreover, nothing in sections 12-37-90 or 12-60-2540 gave Antley the sole discretion in determining which cases to appeal. If the General Assembly had intended the assessor’s right of appeal to be unfettered by the county administrator or county council, it certainly could have provided that the decision of whether or not to appeal a board’s determination is solely that of the assessor.”
