342 Ark. 379

Ward v. State

Supreme Court of Arkansas

Decided October 12, 2000

Supreme Court of Arkansas · decided 2000-10-12

Relies on Rogers v. State

Decided 2000-10-12

Per Curiam.

¶1Appellant Katherine Ward, by and through her attorney, has filed a motion for rule on clerk. Her attorney, David R. Cannon, states in the motion that the record was tendered late due to a mistake on his part.

¶2 We find that such an error, admittedly made by an attorney for a criminal defendant, is good cause to grant the motion. See In Re Belated Appeals in Criminal Cases, 265 Ark. 964 (1979) (per curiam).

¶3The motion is, therefore, granted. A copy of this opinion will be forwarded to the Committee on Professional Conduct.
