The facts disclosed by the pleadings are as follows: In 1902, defendant’s predecessor, the Philadelphia Rapid Transit Company (hereinafter called “P. R. T.”) was incorporated under the Act of March 22, 1887, P. L. 8, as a street railway company, and, until the year 1940, operated a system of street passenger railway lines in the City of Philadelphia and vicinity.
