350 So. 2d 174

State v. Dorsey

Supreme Court of Louisiana

Decided September 19, 1977

Supreme Court of Louisiana · decided 1977-09-19

Relies on 343 So. 2d 722 - State v. Ross · State v. Mouton

Decided 1977-09-19

CALOGERO, Justice

¶1(concurring).

¶2I concur in the affirmance of defendant’s conviction. I do not agree however, that appellant’s contention of incompetent counsel is a matter that can be determined from the record itself nor that such contention should be reviewed on this appeal. Allegations of ineffective assistance of counsel are more properly raised by a writ of habeas corpus. State v. Ross, 343 So.2d 722 (La.1977); State v. Mouton, 327 So.2d 413 (La.1976).
