¶1In re: John R. Killian, applying for writs of certiorari, prohibition and mandamus.

¶2Writ denied in part, granted in part; Denied as to conviction. However, sentence must be vacated to the extent in conflict. La.C.Cr.P. Art. 8S4 (1968), and remanded for re-sentencing.

CALOGERO and DENNIS, JJ., are of the opinion the writ should be granted.
