355 Ark. 390

Patrick v. State

Supreme Court of Arkansas

Decided December 11, 2003

Supreme Court of Arkansas · decided 2003-12-11

Relies on Rogers v. State

Decided 2003-12-11

Per Curiam.

¶1Eddie Lee Patrick, Jr., by his attorney, has filed a motion for a rule on the clerk.

¶2His attorney, Donald E. Warren, Sr., admits in his motion that the record was tendered more than seven months beyond the date of judgment due to a mistake on his part.

¶3 We find that such an error, admittedly made by the attorney for a criminal defendant, is good cause to grant the motion. See In Re: Belated Appeals in Criminal Cases, 265 Ark. 964 (1979) (per curiam).

¶4The motion for rule on the clerk is, therefore, granted. A copy of this opinion will be forwarded to the Committee on Professional Conduct.
