Fairow v. State

Supreme Court of Arkansas

Decided September 9, 2004

Supreme Court of Arkansas · decided 2004-09-09

Relies on Rogers v. State

Decided 2004-09-09

Per Curiam.

¶1 Appellant Barry Fairow, by and through his attorney, Dennis R. Molock, has filed a motion for rule on clerk. Mr. Molock states in the motion that the notice of appeal was not filed in a timely fashion due to a mistake on his part.

¶2 We find that such an error, admittedly made by an attorney for a criminal defendant, is good cause to grant the motion. See In Re Belated Appeals in Criminal Cases, 265 Ark. 964 (1979)(per curiam).

¶3 The motion is, therefore, granted. A copy of this opinion will be forwarded to the Committee on Professional Conduct.
