Posture: SUMMARY OF DECISION After entering a judgment for defendants, the trial court had jurisdiction to enter a new judgment for plaintiff, even though overruling plaintiff's motion for new trial. The consideration at a tax sale was grossly inadequate, but the tax sale should not be set aside where the plaintiff was not a purchaser for value and delayed for several years while the property was increasing in value and a purchase agreement had been made with additional parties. Plaintiff is entitled to a money judgment for damages on account of interference with his right of possession before the tax deed was issued. A new judgment should be entered as directed by the opinion.Appeal from Jackson Circuit Court; Hon. Emory H. Wright, Judge. REVERSED AND REMANDED ( with directions ).
