¶1Before us is a question of law certified to us by the circuit court as being proper for our consideration under Fla.App. Rule 4.6 (1962). We have determined this case to be controlled by Boyer v. City of Orlando, 232 So.2d 169 (Fla.1970) and therefore respectfully decline to answer the questions and remand this matter to the circuit court.
