CALOGERO, Justice,

¶1dissenting.

¶2I respectfully dissent, believing that denial of the new trial sought by defendant was an abuse of the trial court’s discretion under the circumstances. The record in this case, revealing the facts to which my brother Tate briefly alludes in his concurring opinion, exhibits the need for retrial in the interest of justice.
