  1. “[SJtates may not, by the device of creating courts of limited jurisdiction, avoid the constitutional mandate against placing a person twice in jeopardy for the same offense. ... The decision reached herein [dismissal of the case on double jeopardy grounds] does not impose an undue hardship on the state.
