Hurel v. Couget

Louisiana Court of Appeal

Decided December 6, 1979

Louisiana Court of Appeal · decided 1979-12-06

Decided 1979-12-06

BEER, Judge,

¶1dissenting in part.

¶2Upon deliberation, the jury concluded that the defendant had reasonable cause to detain the plaintiff. Thus, we are here confronted, from a quantum standpoint, with a consideration of whether or not an award of $4,000 is justified for such excessive restraint as was here imposed. Giving *MCDLVIthe plaintiff the benefit of every doubt, this record cannot support such an award. The jury manifestly erred. It should be reduced.
