Burgest v. Scott

U.S. Courts of Appeals

Decided June 21, 2002

U.S. Courts of Appeals · decided 2002-06-21

Applies 28 U.S.C. § 2241 (Antiterrorism and Effective Death Penalty Act of 1996)

Affirmed by unpublished PER CURIAM opinion · Decided 2002-06-21

PER CURIAM.

¶1 Lamar E. Burgest, III, appeals the district court’s order denying relief without prejudice on his 28 U.S.C. § 2241 (1994) petition. We have reviewed the record and the district court’s opinion and find no reversible error. Accordingly, we affirm on the reasoning of the district court. See Burgest v. Scott, No. CA-01-248-3 (E.D.Va. Dec. 12, 2001). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process.

¶2 AFFIRMED.
