¶2While I agree here, as I did in Murray, that the refusal to instruct the jury in regard to the penalty was harmless error, I must say it was error and express my hope the instruction will be given when requested, henceforth, in order to avoid unnecessary appellate litigation and eventual rulings of a corrective nature.
