[1] CRIMINAL LAW — JUDGMENT AND SENTENCE — DEFERMENT OF SENTENCE. Deferment of sentence followed by probation is for the purpose of giving an opportunity for reformation of persons who, the trial court believes, are entitled thereto and who are eligible under the statute. [2] PARDON — PAROLE — NATURE OF RIGHT OR PRIVILEGE. The granting of parole is not a matter of right but is a matter of grace, privilege, or clemency granted to the deserving and withheld from the undeserving, as sound official discretion may dictate. [3] CRIMINAL LAW — JUDGMENT AND SENTENCE — DEFERMENT OF SENTENCE — NATURE OF RIGHT OR PRIVILEGE. Under Rem. Rev. Stat. (Sup.), § 10249-5a and -5b, deferment of sentence and probation are not rights belonging to the defendant, but, upon a plea or verdict of guilty, they become a disciplinary measure which the trial judge may use within the limits of the statute, its use being solely dependent upon his sound discretion. [4] SAME — APPEAL — DECISIONS REVIEWABLE — ORDERS RELATING TO DEFERMENT OF SENTENCE. An order deferring sentence and granting probation is not a final judgment and is therefore not appealable; since the defendant in a criminal action may appeal only from a final judgment, and, until sentence has been pronounced, there is no final judgment. [5] SAME. A defendant whose sentence has been deferred and who has been placed on probation has the same right to petition for modification of the conditions of his probation as he had to request the court for probation in the first instance; however, an order denying the petition, which was addressed to the discretion of the court, is of no higher rank than the order granting his request for probation, and is not appealable. [3] See 101 A.L.R. 1402; 15 Am. Jur. 134.
