¶1concurring specially:

¶2I concur and in so doing commend Judge Hurley for his usual excellence in going to the trouble of playing the tapes which establish the accuracy of the majority opinion’s version of the facts. However, this information could never have been deduced from the briefs as filed nor was any argument based thereon.

¶3I would warn all who come before us that there will be few occasions when we can afford the time to unearth the truth in such a manner.
