Most-quoted passages
The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 4 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.
“The defendant testified as a witness in this case, and you will weigh his testimony in the same manner as you weigh the testimony of other witnesses who appeared in the case. Just because he is the defendant is no reason for you to disregard and set aside his testimony. You will give his testimony the weight it is entitled to receive taking into consideration his interest in the outcome of the case and applying to his testimony the same rules that you apply to the testimony of all other witnesses who appeared in this case. It is for you to determine what weight that you will give to the testimony of any witness who appeared in this case.”
1 later decision quote this exact passage““* * * to avoid the pitfall of Griffin v. California, the trial court would have been compelled to limit its instruction to precisely what was said * * * [in the charge quoted in the text].” (Bracketed material added.)”
