400 So. 2d 899

State v. Baylis

Supreme Court of Louisiana

Decided July 21, 1981

Supreme Court of Louisiana · decided 1981-07-21

Decided 1981-07-21

DENNIS, Justice,

¶1dissenting.

¶2I respectfully dissent. Defendant’s statements to law enforcement officials and the evidence obtained as a result of those statements should have been suppressed. I believe the state did not bear its burden of proof of showing that the statement made to the sheriff was made freely and voluntarily. Nor did the state prove that the seizure of the murder weapon was not tainted by defendant’s prior wrongfully induced statement made to the district attorney.
