41 Ga. App. 376

King v. State

Court of Appeals of Georgia

Decided April 16, 1930

Court of Appeals of Georgia · decided 1930-04-16

Decided 1930-04-16

Bloodworth, J.

¶1The accused was charged with simple larceny, and when tried a verdict of guilty was returned. The evidence did not show, as alleged in the accusation, that the defendant wrongfully and fraudulently took and carried away with intent to steal the same, certain cottonseed, the property of L. O. Brown; and the trial court erred in not granting a new trial.

¶2Judgment reversed.

Broyles, O. J., and Luke, J., concur.
