LEMMON, Justice,

¶1concurring in denial of rehearing.

¶2While the motion to quash must be overruled, defendant may apply to the trial court for other more appropriate relief. At trial, defendant may introduce any evidence showing that the state negligently destroyed evidence possibly beneficial to defendant or failed to perform all of the usual tests for rape.
