<center> SYLLABUS BY THE COURT</center>1. CRIMINAL LAW — <italic>Criminal Restraint — Sufficiency of Evidence That</italic><italic>Defendant Substantially Interfered with Victim's Liberty.</italic> Whether there was substantial interference with the victim's liberty so as to constitute criminal restraint pursuant to K.S.A. <cross_reference>21-3424</cross_reference> is generally a question of fact to be determined by the jury based upon all the circumstances. 2. SAME — <italic>Criminal Restraint — Facts Sufficient under Facts of Case to</italic><italic>Support Convictions.</italic> Whether a restraint, which the defendant claims is merely incidental to the choking of the victim as part of an aggravated battery, supports a conviction for criminal restraint is examined in light of <italic>State v. Buggs</italic>, <cross_reference>219 Kan. 203</cross_reference>, <cross_reference>547 P.2d 720</cross_reference> (1976). Under the facts presented, there is substantial evidence to support the defendant's conviction of criminal restraint. 3. SAME — <italic>Aggravated Battery — Element of Potential Harm, Not Actual</italic><italic>Harm.</italic> Aggravated battery under K.S.A. <cross_reference>21-3414</cross_reference>(a)(1)(B) focuses on the potential that great bodily harm, disfigurement, or death can be inflicted upon the victim, not whether any of these consequences actually occurred. 4. SAME — <italic>Aggravated Battery — Jury Question Wliether Injury Could Cause</italic><italic>Great Bodily Harm.</italic> Whether an injury could cause great bodily harm under K.S.A. <cross_reference>21-3414</cross_reference>(a)(1)(B) is a question for the jury. To support a conviction of aggravated battery under this provision the State need not prove that great bodily harm or disfigurement was actually inflicted, only that it could have been inflicted. 5. STATUTES — <italic>Constitutionality — Courts Construe Statute as</italic><italic>Constitutionally Valid When Reasonable Way to Do So.</italic> Courts presume a statute is constitutional and resolve all doubts in favor of its validity. Courts construe a statute as constitutionally valid when there is a reasonable way to do so without ignoring the apparent intent of the legislature in enacting it. 6. CRIMINAL LAW — <italic>Domestic Battery — Statute Determined to Be</italic><italic>Constitutional.</italic> The Kansas domestic battery statute, K.S.A. <cross_reference>21-3412a</cross_reference>, when applied to unmarried cohabitating couples, is not unconstitutional due to a conflict with Kansas' Defense of Marriage Amendment to the Kansas Constitution, art. <cross_reference>15</cross_reference>, § 16 (2008 Supp.).
