<center> SYLLABUS BY THE COURT</center>TAXATION — <italic>Group Home for Low-income People with Special Needs Exempt</italic> <italic>from Real Estate Taxes</italic> — <italic>Federal Tax Credit to Provide Funds for</italic> <italic>Low-income Housing Does Not Negate Real Estate Tax Exemption.</italic> K.S.A. 2009 Supp. <cross_reference>79-201b</cross_reference> <italic>Sixth</italic> provides a real-estate tax exemption when property is used exclusively as a group home for low-income people with special needs and other statutory requirements are met. A federal statute, 29 U.S.C. § 42 (2006), provides tax credits that can be used to help provide funding for low-income housing projects. Under the facts of this case, the use of those tax credits to build a group home otherwise exempt from taxation under K.S.A. 2009 Supp. 79-20lb <italic>Sixth</italic> does not constitute a separate use of the property so as to negate the required exclusive use as a group home.

CRIMINAL LAW — <italic>Diversion</italic> — <italic>Contractual Relationship between Defendant</italic> <italic>and State.</italic> A criminal diversion agreement is essentially a contract between an individual and the State. 2. SAME — <italic>Driving under Influence</italic> — <italic>Prior Driving under Influence</italic> <italic>Diversion Agreement Considered Prior Conviction for Enhanced Sentencing</italic> <italic>Purpose</italic> — <italic>Prior Diversion When Defendant Was a Minor Still Counts as</italic> <italic>Prior Conviction.</italic> A diversion agreement entered into in lieu of further criminal proceedings on a charge of driving under the influence is considered a prior conviction under K.S.A. 2007 Supp. <cross_reference>8-1567</cross_reference> for purposes of enhancing an offender's sentence for a subsequent DUI conviction. The fact that the offender was a minor at the time he or she entered into the prior diversion agreement does not alter this statutory provision.
