¶1Inasmuch as the circuit court has ruled on the matter pending below, the petition for writ of mandamus is dismissed as moot. This disposition is without prejudice to petitioner’s exercise of his right to appellate review of the merits of the circuit court’s ruling in the pending proceeding in case number 1D10-5079.
