¶1Rumlin appeals from the dismissal of her amended complaint which alleges negligence on the part of the Gadsden County Sheriffs Department.

¶2We affirm because the amended complaint does not allege a breach of a legally cognizable duty. Everton v. Willard, 468 So.2d 936 (Fla.1985); Trianon Park Condominium Association, Inc. v. City of Hialeah, 468 So.2d 912 (Fla.1985).

¶3AFFIRMED.
