  1. “It is the determination of damages that requires the replacement of goodwill____ There is cost involved when something is replaced. The model must account for that. [Plaintiffs] right to use supervisory goodwill on its books was taken away by FIRREA. Damages are sought to replace that asset. Those damages cannot be calculated without accounting for the cost of replacement.
