That sentence was appealed to the 2nd Circuit Court of Appeals. It was upheld by a three judge panel on the 2nd Circuit after a hearing, and then appealed to the Louisiana Supreme Court, which issued the following order, and I quote: "Granted. Sentence, apparently severe, is set aside. Remanded to the District Court in compliance with La.C. Cr.P. Art. 894.1."”
