Supreme Court of Alabama

Decided June 15, 1872

Supreme Court of Alabama · decided 1872-06-15

This was an application for a mandamus to compel the circuit coiu’t of Autauga to make appropriate orders to return the case of the State of Alabama v. W. E. Dennis, and the trial thereof, on an indictment against said Dennis for an assault with intent to murder, to the city court of Montgomery.

Decided 1872-06-15

B. E. SAEEOLD, J.

¶1Section 4206 of the Eevised Code prescribes the causes for which a case of this sort may be transferred to another county, and directs the manner in which it shall be done. Under it this case has been removed from the county where it originated. Section 4207 declares that the trial can be removed but once.

¶2We have no authority to hold, that the agreement of counsel to that effect is a ground for the change of venue in a criminal case.

¶3The mandamus is refused.
