¶1ON MOTION TO RELINQUISH JURISDICTION

PER CURIAM.

¶2We treat respondent/appellee’s “motion to relinquish jurisdiction to the circuit court for the purpose of making further factual determinations” as a partial confession of error. Therefore, the order denying appellant’s petition for writ of mandamus is reversed and this cause is remanded with instructions that the petition be reconsidered in light of respondent’s present position.
