Chief Judge Cooke

¶1(concurring). I concur in the result, and do so on State constitutional grounds (cf. Sharrock v Dell Buick-Cadillac, 45 NY2d 152, 159-161; see, also, People v Isaacson, 44 NY2d 511). In view of the construction afforded our State Constitution, it is unnecessary to resolve any issue of Federal constitutional law.
