Lombard v. Hayner

Appellate Court of Illinois

Decided January 13, 1880

Appellate Court of Illinois · decided 1880-01-13

Change of venue.—The affidavit, the only evidence offered on the application for a change of venue, failing to show that the judge was in any manner, directly or indirectly, interested in the cause, the motion for change of venue, based upon the interest of the judge, was properly denied.

Decided 1880-01-13

Pee Curiam.

¶1The only error assigned in this case is that the court below refused to grant a change of venue.

¶2The cause alleged in support of the motion for the change, was the interest of the judge.

¶3The only evidence in the record relied upon to show that he was in any manner interested, is the affidavit of appellant. This affidavit wholly fails to show that the judge was in any manner interested in the cause, either directly or indirectly.

¶4The motion below was, therefore, properly overruled, and the judgment is affirmed.

¶5Judgment affirmed.
