¶1concurring: I concur with the well-reasoned opinion of Judge Hill, but I write separately only to note my objection to any suggestion that this court would have granted a motion to remand this case to the district court for Walker to file an amended notice of appeal — out of time — to supplement the limited notice of appeal he did timely file. That issue was not before us, and I have serious reservations about the success of such a motion. Accordingly, I decline to support the statement, even though it is mere dicta.
