TYSON, Judge

¶1dissenting.

¶2I dissent from the majority opinion in this cause. In my opinion, the appellant’s proof in circuit court established that he had rendered “substantial assistance” to the district attorney’s office in furtherance of his plea bargain negotiations.

¶3On authority of Yarber v. State, 437 So.2d 1330 (Ala.1983), I would award the writ of mandamus in this cause.
