¶2I agree that the order appealed should be affirmed upon a determination that the challenged statute, as applied, is impermis-sibly vague. However, since it is unnecessary to address the issue, I express no view as to that portion of the majority opinion which purports to “reverse” the lower court’s alternative ruling on the question of delegated legislative authority.
