¶2I concur in the opinion of Judg^ Bussey, although careful consideration has been given the persuasive dissenting opinion of Judge Brett. I think the entire record in this case justifies the verdict, and that the defendant had a fair and impartial trial.
¶3However, appellant’s attention is directed to the provisions of 22 O.S.1971, § 994.
